1. Purpose
These terms govern access to and use of the FobizGrowth website and platform, published by FobizGrowth SARL. Creating a workspace or using the platform means accepting these terms. The terms for buying the subscription and services are set out in the terms of sale.
2. Workspace and accounts
A workspace is created by an authorised representative of the company, who becomes its owner. The owner invites colleagues and assigns their roles, and answers for how the people they invite use the workspace.
You agree to provide accurate information and to keep your password confidential. Any action taken with your credentials is deemed to be yours. Report any unauthorised use without delay to [email protected].
3. Acceptable use
In particular, you must not:
- access or attempt to access another workspace’s data;
- bypass security measures, test the platform without written permission, or disrupt its operation;
- extract the platform’s models, questionnaires or content by automated means;
- enter unlawful content, or personal data without a legal basis.
4. Your data
The data you enter (assessed companies, answers, documents) remains yours. You grant FobizGrowth SARL the right to process it only as far as needed to provide the service. For personal data about third parties that you enter, FobizGrowth SARL acts as a processor, on your instructions.
How we process data about you is described in the privacy policy.
5. Intellectual property
The scoring models, their weightings, the platform and its content belong to FobizGrowth SARL. You receive a personal, non-exclusive, non-transferable right of use for the duration of your subscription. Reports and scores produced for your company may be used freely by it.
6. Availability
We take reasonable steps to keep the platform available, without guaranteeing uninterrupted access. Interruptions may occur for maintenance or in cases of force majeure.
7. Liability
Scores and analyses produced by the platform are decision-support tools: they rely on the answers provided and do not replace professional advice. Decisions taken on their basis are your sole responsibility.
FobizGrowth SARL is liable only for proven fault, limited to direct damage and capped at the amounts paid over the previous twelve months.
8. Suspension and termination
We may suspend an account for a serious breach of these terms, after a formal notice has gone unanswered, except in security emergencies. You may ask to close your workspace at any time at [email protected].
9. Governing law and disputes
These terms are governed by Cameroonian law. Failing an amicable settlement, any dispute falls within the jurisdiction of the competent courts of Douala.
